1. Introduction and Acceptance of Terms

Welcome to Clany. These Terms and Conditions (“T&C”) govern your access to and use of the Clany application, dedicated to the management of family and personal calendars. By registering or using Clany, you formally and fully accept these T&C and our Privacy Policy. If you do not agree, do not use the application.

2. Your Content and License

You retain ownership of all content (photos, events, messages) you upload. However, for the service to operate, you grant us a limited, free, and non-exclusive license to host, reproduce, and display such content only within your Clan and according to your privacy settings.

3. Description of Service

Clany allows you to:

Create and share family and personal calendars.
Generate, edit, and delete events.
Assign tasks or reminders to group members.
Receive push notifications for changes or reminders.

4. Requirements for Account Creation and Use

Minimum Age and Child Protection: You must be at least 13 years old (USA) or 14 years old (Spain/EU) to create an account. Clany allows the management of minor profiles only under the strict responsibility, supervision, and consent of the holders of parental authority or legal guardians.
Information: By signing up, you provide truthful information. You are responsible for keeping it updated.
Security: Your password and any actions on your account are your sole responsibility.

5. General Conditions of Use

Member Creation: Clany allows users to create profiles to manage the group's agenda. The user who creates a profile guarantees they have the authority or necessary consent to enter such data.
Guest Management: Users are responsible for who they invite to their Clan and for the use these third parties make of the shared information.
Responsibilities: Use the service lawfully and do not share credentials.
Intellectual Property: Clany and its content are protected by copyright.
Advertising: Ads are shown via AdMob, customizable under consent.
Prohibited Uses: You may not use Clany to upload illegal, violent, pornographic content, or content that infringes on third-party copyrights. Technical attacks (hacking, spam) are strictly prohibited.
Indemnification: You agree to indemnify Clany against any third-party claims arising from your misuse of the app or the content you post.

6. Integration with Third Parties

We use external services to ensure the app's operation:

Firebase (Analytics and Notifications).
RevenueCat: Technology used for the secure management and processing of subscription statuses.

7. Suspension and Cancellation

User Deletion: You can request account deletion from the app. Upon doing so, access will be revoked immediately, and your personal data will enter a 48-hour latency period before its definitive and irreversible anonymization or deletion. During this period, you may cancel the deletion process and recover your information simply by re-registering. After these 48 hours, it will undergo irreversible anonymization definitively.
Suspension: We reserve the right to suspend or close your account for serious breach of these T&C, fraudulent use, or prolonged inactivity. In the case of premium subscriptions, transaction-related data will be retained to comply with legal and tax obligations.

8. Disclaimer and Limitation of Liability

      🗓️ Calendar Use: Clany is exclusively a support and logistics tool. Users are recommended to always independently verify their critical appointments (medical, school, legal), as Clany is not responsible for damages arising from external technical failures, notification delays, or synchronization errors.
    

Clany is offered “as is” without guarantees of absolute availability.
We will not be liable for data loss beyond what is stipulated by current consumer law.

9. Applicable Law and Jurisdiction

These T&C are governed by Spanish and European legislation (GDPR). For any dispute, we will attempt an amicable resolution. If not possible, the parties submit to the Courts and Tribunals of Barcelona, Spain.

Prevalence of Language: The official and legally binding version of this agreement is the one written in Spanish. Any translation is provided solely for user convenience. In case of discrepancy or ambiguity, the Spanish version shall prevail at all times.

10. Subscriptions and Secure Payments

Clany offers Premium subscriptions managed securely through official stores (App Store or Google Play) via RevenueCat technology.

Subscriptions renew automatically unless cancelled 24 hours before the end of the period.
Payments and bank details are processed directly by the app stores (Apple/Google), not by Clany.
Refund requests are governed by Apple and Google policies.

11. Modification of Terms

Clany may update these T&C to adapt to new features or laws. Significant changes will be notified within the app. Continued use implies acceptance of the new terms.
